I just read this-

Unfortunately, in the state of North Carolina, it isn’t against the law to communicate with a fugitive. It’s not against the law to know the whereabouts of a fugitive and refuse to reveal that information. So, Christina Laurean once again gets away with helping out her husband.

Is this so?

Sentry--

Maybe because at the time, the child was 18 months old and GJ was talking about the events at that time-- Her post sounds to me like she was talking about the events of that time-

I had heard on the news too about the floor being painted-- One of the neighbor's was being questioned and mentioned the paint being carried in-

I'm not sure where you're getting some of you information, but curious as to where you ever read the floor was painted along with some other statements you've made. The child in question is not 18 months old, she WAS when this case was reported, but we're now into APRIL.

Morning GJ-

I agree with you --- the wife's behavior should be closely examined--She kept in contact with him-- obviously she knew where he was-- If they find any of the messages on Christina's sister's computer, I would imagine someone would want to press charges against her.

What doesn't make sense to me is County Sheriff's Capt. Rick Sutherland said Christina Laurean cooperated with authorities over the course of a three-month international manhunt but Southerland On Friday, Onslow County District Attorney Dewey Hudson said Laurean and his wife, Christina, sent Internet messages to each other through the MySpace social-networking service. Christina Laurean used her sister's computer, which was seized, the North Carolina prosecutor said.

If she was cooperating and the seized computer finds emails being exchanged in the last three months, obviously she was not cooperating -- He could have been tracked down easily!

I am real curious as to how far back these emails go-- and if she had this communication with him in the last three months, she definitely needs to be charged with something. Did Christina's sister know Christina was using her computer to contact Cesar?

And given her age-- 21? Women do the most stupid things ...-- Remember the dentist who ran over her husband with her Mercedes Benz? She never thought about her children or even for that matter thought about her husband's daughter who was in the car as she ran over her husband a few times--

Christina is hiding more than she is disclosing-- If she was emailing him for the last three months, I don't see this as cooperating-- let alone how she helped Cesar paint floors and watched a BBQ pit being built-- and the smell? Human flesh?

I wonder how much of a focus will be placed on Christina?

Thanks for replying-- Off topic-- I believe I saw you on RedEye a few weeks ago too!

Have a great day!!!!

Good points AZ. I just think that the wife’s behavior needs to be closely examined. She was after all also a solid United States marine who also worked on the military base and was not some stay at home mom or civilian wife with limited knowledge about lauterbach. I realize she cannot be forced to testify against her husband, but she certainly can’t under civilian or military law aide or abet him in any way no matter how small, once she knew he committed a crime and we know she admits she knew about lauterbach’s death when she accompanied him to talk to his lawyer just about 24 hrs before he fled, and now there is proof she was in contact with in with her husband by email in Mexico. We also know that she did in fact confront lauterbach on the military base, whose charred remains ends up in her backyard, in a rather large newly dug barbeque pit, and she ignores the fact that her husband painted a floor and she knew he did this, and may have helped him with some of the painting in the house, according to a neighbor that saw her with a paint can. Was she helping him cover up the blood? Who paints a floor? What wife would agree to a ruin a floor like that or not be furious with a husband for painting a without her consent? I thought most people either tile, carpet, or apply some sort of wood veneer, to household floors, unless it’s a cement area like a garage or something?
It’s one thing to stand by an unfaithful husband to fight to save a marriage but to risk going to jail yourself when you have an 18 month old child, is a very big stretch of imagination, unless she was involved in some way all along with the death or cover up would she remain so loyal . She accompanied him to his lawyer, and gave him a 24 hour head start to flea before she tells the authorities his ridiculous story. He leaves with money and then when he runs out of money he asks his wife (he woman he cheated on ) for financial help, and when she refuses he then decides it’s not worth hiding out in Mexico anymore, and contacts the Onslow county Sherriff to negotiate his surrender and allows himself to be caught. When he is caught he tells the authorities he loved Lauterbach. I would like to know if the wife was involved in any way with a physical altercation between herself and Lauterbach off that military base.

GJ--

I saw your interview with Bill the first time and then when it was re-aired--

I had pretty much forgotten what was discussed in the first interview-- I was glad Laura Ingram re-aired it--

thanks for the post--- very informative--

I always wondered too if his wife helped him or gave him the advice to flee to Mexico-- given they have a child (18 months?), the emotional bond would prevail over to do what is legally correct. (and being scared out of one's wits).

#3-- great points--

should be interesting, from your legal perspective, to see what happens-

RALEIGH, N.C. (AP) - Detectives are investigating whether a Marine charged with the brutal slaying of a pregnant colleague from Ohio might have e-mailed North Carolina authorities to ask about turning himself in while he was on the run in Mexico.

However, Onslow County sheriff's officials cautioned today that they are not sure whether a March 30 e-mail that claimed to be from Cpl. Cesar Laurean is genuine. Among other concerns, it was sent with the wrong spelling of Laurean's name.

Sheriff's Capt. Rich Sutherland think it's less than a 50% probability.

Hello Adam , You may recall that yesterday Laura Ingram re-aired my interview with Bill Reilly on the Ceear Laurean’s case yesterday. I hope that I am providing helpful insight on this. I am available to explain further what I believe will be Laurean’s next move, which is to try to use the extradition process to gain an even greater advantage for himself. Although I am a former military prosecutor, as always I tried to anticipate what the defense strategy might be. So here is what I think.
Exactly when we will we see Cesar Laurean step onto North Carolina soil depends on his decision at an extradition hearing within the next 60 days , but there are a few steps that must occur first.

1. Since Mexican Courts are required to prove as a formality that the warrant and arrest was valid that was used to apprehend the right person, and that Cesar Laurean is in fact the man wanted in Onslow County which is why Laurean was interrogated recently and made his first appearance in court on Saturday. After that is officially established, the Judge decides based on the evidence, whether to recommend extradition, and as you just updated us, Adam, this preliminary hearing is now over and the Judge recommended that Lauren should be extradited. Now from here Laurean has two choices. Either waive his right to appeal the judge’s decision and voluntarily return to the United States or fight it by appeal.

2. (Personally I believe Lauren already made his first attempt to avoid extradition, by getting the Sheriff to write that email, which confirms that that civilian prosecutor lacks capacity to assure that the military won’t court martial Laurean and seek the death penalty, and here Lauren was successful on two levels. First, he wanted to get the word out that he wants to strike a deal to avoid being charged by the military and also avoid accountability for on the other crimes, sexual assault adultery etc.; and second, he most likely wanted some type of proof to submit to a judge during the initial court appearance or throughout the appeals process that the Onslow Dar’s assurances are simply not enough force Mexico to extradite him on appeal.

3. If he does decide to appeal extradition, it will be only after he has negotiated with both the military and the civilian authorities for dramatically reduced penalties and we will know this within the next 60 days, which is when Laurean is for the first time required to make his first appearance now that the extradition process has begun, and will for the first time be required to put on the record either a waiver of his right to appeal or a decision to fight. He could win at the at the first appellate level, if he successfully argues that while the Onslow County anti- death assurances simply are not enough since it does not bind the military, and therefore extradition under these circumstances violates the treaty. If he loses his first appeal, Mexico has a lengthy appellate process available to him under Mexican law as a Mexican citizen which could take years? Theoretically Laurean could appeal all the way to the Mexican equivalent of a Supreme Court, and Lauren could use the time factor as a bargaining tool. He knows we want him back to face justice in the United States ASAP and we really don’t like the idea of waiting years for his return, and to add insult to injury he is one of our marines, and it does not bode well to see him milk this thing and turn it into an international issue with great media attention involving the conduct of one of our United States Marines evading our judicial system.

4. What is Laurean’s most likely course of action or defense strategy?

Answer: Lauren will most likely have his attorney who he may have hired before he fled North Carolina, get him representation in Mexico and then start structuring Lauren’s position within the next 60 days, to expose Laurean to serve the least amount of time behind bars, negotiate with both the military and civilian authorities to clarify the jurisdictional issues and ensure that all additional charges sexual assault, adultery, fraud, mishandling of a corpse, aren’t pursued, and he may even have an eye towards a reduction of the first degree murder charge to be reduced to a non life sentence crime.

. I’m afraid that he could technically use his choice to use discretion to waive his appeal of extradition as his the primary negotiation tool. This is why:

   – At this time Laurean faces life in prison in Onslow county as a civilian if he is extradited, but if he fights and wins an appeal he most likely will not get anything near a life sentence in Mexican court but he would put himself in physical grave danger if he spends any amount of time in a Mexican prison which are typically very dangerous, corrupt, lacking proper sanitation and prisoners are underfed and malnourished.

I still have a few additional questions about his wife’s conduct. What did she say to Lauterbach when she confronted her on the military base? Did she aid him in any way by not going to authorities immediately, and since she herself is a marine she may face charges by The marines, for her conduct since it is clear that the Onslow DA will not take action. Did she provide him with advice as to what type of strategy to pursue, i.e. flee to Mexico to evade the law.

Regards,

Gwen Lindsay-Jackson, Esq.

Derek and Vic,

you both make very excellent points. its great to see people have what you can actually call a civil debate. I only disagree with one point made by Derek. As far as the military investigating the matter thoroughly in response to the rape claim, and what was reported in their Inspector General inspection, of how did the Military Times put it "the lack of paper work that was reported with this investigation" I have my doubts. There were two orders of protection placed against him only one of which was enforced. Could she have been lying about it? yes.......but for someone who is a compulsive liar... she sure did tell the truth an awful lot. During the investigation she admitted that the first encounter was consensual. For validation of that fact check the Marine Times. She admitted to both the investigators and a friend of Cpl Lauren's that the first encounter was consensual, it was when she found out that He had no intention of breaking it off with his wife that she stated she no longer wanted to have sexual relations with him. By admitting the first encounter was consensual she put her own career in jeopardy. She could and would have been charged with adultery. As for her stop mother, it has been reported by the media she too is a compulsive liar and never had a good relationship with her daughter. I think its too late to ever find out if she was raped, and proving that he is the father of the child won't prove a thing after she admitted to having consensual sex with him at least one time. But I do believe he killed that young girl and he ran to flee the consequences. Though once again I'd like to say great job to the both of you for holding at least in my eyes a civil debate over an issue that will be carried out for at least a year or two.

Hey Derek I agree with everything you've said...this guy just has to tell the whole truth and if he does, he may tell the courts how she did harrass him, if he doesn't tell the truth then it's his ass, Ny guess is he'll lie all the way through and end up in prison for life.

Derek-

I guess I lied about my final post...you gotta stop replying to them(LOL). That just makes me want to sit down and answer right away (which I really prefer to do instead of what I have right now). Thanks for welcoming me, glad to know I'm in very good company, and for the caveats about the wild ladies - haven't messed with those since my bachelor days, am not about to start now!
More power to you!

vic-

haha, should have figured you were ex military, welcome to the blog, I haven't seen you around here, but we get some really great debates going, as a Vet, you would be chiming in on some, there are several of us vets here...me, retread, LDG (unknown service but he is a vet), rod venger, john (I think). There are a lot of other people that are very intelligent and it makes for a good time.

There is also a pack of wild ladies running around here, approach with extreme caution, they are not a force to be mettled with

Derek-

Me again! Thank you for the compliment (right back at you). And I'd also like to say that that last paragraph in your last post struck a familiar chord with me. You see, I am retired Navy - and that tells me we ARE seeing this case from exactly the same vantage point, but maybe from slightly (emphasis on "slightly") different angles.
Yeah, I remember the kids who needed anything from a slight nudge to get them going on the straight and narrow to the ones who commited the most grievous of transgressions - the ones you loved and the ones you loved to hate - but in each case we commit ourselves to professionalism. We praise publicly, and berate or punish privately. And we never forget that in the end, it's all about the guy next to you.
Well, again, thank you for the lively discussion...this is my final post today. Gotta get some work done!

I actually have mixed feelings regarding the Chinese security forces "guarding" the Olympic torch. I don't like the idea of them pushing Americans out of the way that are exercising their freedom of speech in their own land........on the other hand, Since they brought the torch here and if something were to happen "in close", they would be the ones sacrificing their safety and not our guys.
